1. Who we are

These terms apply to all quotes, supply and installation work by Powerband Electrical Pty Ltd (ABN 29 539 700 510, ACN 656 221 322), Registered Electrical Contractor 32300, of U44/10 Speedwell Street, Somerville VIC 3912 ("Powerband", "we", "us"). By accepting a quote you agree to these terms. Where a signed contract or a Domestic Building Contract applies to a job, that document prevails over these terms to the extent of any inconsistency.

2. Quotes

Quotes are valid for 30 days from the date issued unless stated otherwise. A quote is based on the information available at the time, including site inspection, photos and details you provide. Rebate and incentive amounts shown on a quote are the published program amounts at that date and are subject to your eligibility and the program rules at the time of installation. Prices include GST unless stated otherwise.

3. Acceptance and deposit

A job is confirmed when you accept the quote in writing (email or e-signature is sufficient) and, where requested, pay the deposit stated on the quote. Deposits are applied to the final invoice. For work covered by the Domestic Building Contracts Act 1995 (Vic), deposit limits and contract requirements under that Act apply.

4. Site conditions and variations

Our quote assumes normal access and site conditions. If, once work begins, we find conditions that could not reasonably have been identified at inspection (for example non-compliant existing wiring, asbestos, concealed damage, switchboard defects, structural issues or roof access problems), we will stop, explain the issue and give you a written variation with a fixed price before proceeding. No variation work is done without your approval.

5. Rebates and incentives

Where a quote includes a Victorian Energy Upgrades discount, small-scale technology certificates, a Solar Victoria rebate, the federal Cheaper Home Batteries discount or any other incentive, the discount is conditional on you being eligible, providing the documents and declarations the program requires, and the program remaining open at the time of installation. By accepting the quote you assign the relevant certificates to Powerband or its nominated agent. If an incentive is withdrawn or reduced before installation for reasons outside our control, we will tell you in writing before proceeding and you may cancel without penalty.

6. Scheduling and access

We will agree an installation date with you and confirm it. You agree to provide safe, clear access to the work areas, switchboard, roof and meter, and to ensure someone over 18 is present or has authorised access. If we attend and cannot proceed because access was not provided as agreed, a reasonable call-out fee may apply.

7. Payment

Unless the quote states otherwise, the balance is due on completion of the work. Invoices are payable within 7 days. We accept bank transfer and card. Title in goods supplied remains with Powerband until paid in full. We may charge reasonable costs of recovery on overdue accounts.

8. Cancellation

You may cancel a confirmed job by written notice. If you cancel more than 5 business days before the scheduled installation date, any deposit is refunded less the cost of non-returnable goods ordered specifically for your job. If you cancel within 5 business days, we may retain the deposit to the extent of costs incurred. Statutory cooling-off rights under Australian Consumer Law and the Domestic Building Contracts Act are not affected.

9. Warranties

Our workmanship is warranted for the period stated on the quote, and in any case for no less than the period required by law. Products are covered by the manufacturer’s warranty, which we will register on your behalf where the manufacturer allows, and we will assist with any warranty claim. Nothing in these terms excludes the consumer guarantees under the Australian Consumer Law. Warranties do not cover damage caused by misuse, unauthorised modification, work by others, power surges, pests, weather events or failure to maintain the system as recommended.

10. Compliance and certificates

All electrical work is performed by licensed A-Grade electricians and a Certificate of Electrical Safety is issued for prescribed work. Gas and plumbing work is performed by licensed practitioners with the relevant compliance certificate. Grid connection of solar and battery systems is subject to your electricity distributor’s approval and export limits, which we arrange but do not control.

11. Your responsibilities

You confirm you are the owner of the property or have the owner’s authority to have the work done. You agree to tell us about anything at the property that could affect the work or the safety of our people, including known asbestos, unsafe structures and animals.

12. Liability

To the extent permitted by law, our liability for any claim arising from the work is limited to re-performing the work or refunding the amount paid for the affected work, at our election. We are not liable for indirect or consequential loss, including loss of feed-in income or energy savings that differ from estimates. Estimates of savings, production or payback are indicative only and depend on your usage, tariffs and weather.

13. Privacy

We handle personal information in line with our Privacy Policy. Information needed to lodge rebates is shared with the relevant government program and its agents as those programs require.

14. Disputes and law

If something goes wrong, tell us and we will try to fix it quickly. Consumer disputes may also be referred to Consumer Affairs Victoria, Domestic Building Dispute Resolution Victoria or VCAT. These terms are governed by the laws of Victoria.

15. Changes

We may update these terms from time to time. The version on this page at the date you accept a quote is the one that applies to that job.
