1. About this policy

Powerband Electrical, ABN 29 539 700 510, of Unit 44/10 Speedwell Street, Somerville VIC 3912 (“Powerband Electrical”, “we”, “us”, “our”) provides solar, battery, EV charging, heating and cooling, and general electrical services to customers across Victoria. This policy explains how we collect, hold, use and disclose personal information, in line with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).

This policy applies to personal information we collect through our website, over the phone, by email, in person during quotes and installations, through competitions and promotions we run (including via third-party entry platforms), and through our social media pages.

2. The personal information we collect

Depending on how you interact with us, we may collect:

• Contact details — name, residential or business address, email address, and phone number.

• Property and service details — property address, type of dwelling, roof/switchboard details, current energy usage or bills, and other information relevant to preparing a quote or completing an installation.

• Government rebate information — details required to apply for or lodge rebates and incentives on your behalf, such as the Victorian Solar Homes Program (Solar Victoria) or Small-scale Technology Certificates (Clean Energy Regulator), including information verifying eligibility (e.g. combined household income, property ownership).

• Payment and billing information — invoicing details and payment records (we do not store full credit card numbers; these are handled by our payment provider).

• Competition and promotion entries — name, postcode, mobile number, email address, and social media handle/username, where you enter a giveaway or promotion we run.

• Social media and marketing interactions — information you provide when you follow, message, comment on, or otherwise interact with our Facebook, Instagram, or other social media pages.

• Website usage information — general browsing information collected through cookies and similar technology (see Section 8).

3. How we collect personal information

We collect personal information directly from you where practical, including when you:

• Submit an enquiry, quote request, or contact form on our website.

• Speak with us by phone, email, or in person.

• Book or complete an installation or service with us.

• Enter a competition or giveaway we run, including through third-party entry platforms (such as SweepWidget) or by following/engaging with our social media pages.

• Interact with our Facebook or Instagram pages or respond to our advertising.

Occasionally we may also collect personal information from third parties, such as a referring customer, a government body processing a rebate application, or a marketing/CRM platform that manages our customer communications on our behalf — but only where it is unreasonable or impractical to collect it directly from you, or where you have consented to that information being shared with us.

4. Why we collect, hold, use and disclose your information

We collect and use personal information to:

• Provide quotes, and design, schedule, and carry out installations and electrical services.

• Apply for and lodge government rebates and incentives on your behalf, where you have engaged us to do so.

• Process payments and manage invoicing and warranty records.

• Run and administer competitions and promotions, including verifying eligibility, contacting winners, and meeting the conditions in the relevant terms and conditions.

• Send you marketing communications about our products, services, and promotions, where you have not opted out (see Section 7).

• Respond to enquiries, feedback, and complaints.

• Meet our legal, accounting, insurance, and regulatory obligations.

• Improve our website, services, and marketing based on aggregated or de-identified data.

5. Who we may disclose your information to

We do not sell personal information. We may disclose personal information to:

• Our staff and subcontracted installers or trades, to the extent needed to carry out a quote or installation.

• Government bodies administering rebate and incentive schemes, such as Solar Victoria and the Clean Energy Regulator, where you have asked us to lodge an application on your behalf.

• IT, CRM, and marketing service providers who help us manage customer relationships, communications, and competition entries (for example, GoHighLevel and SweepWidget).

• Social media and advertising platforms, such as Meta (Facebook and Instagram), for the purpose of running and measuring advertising and promotions.

• Payment processors, to process transactions securely.

• Our accountants, insurers, and professional advisers, where reasonably necessary.

• Any other party where required or authorised by law, or with your consent.

6. Overseas disclosure

Some of the service providers we use — including cloud-based software platforms and social media companies such as Meta — may store or process personal information on servers located outside Australia, including in the United States. Where this occurs, we take reasonable steps to ensure these providers handle personal information in a manner consistent with the Australian Privacy Principles, but we encourage you to review the privacy policies of major platforms (such as Meta) directly, as their handling of information outside Australia is governed by their own terms.

7. Direct marketing

We may use your contact details to send you marketing communications about our products, services, competitions, and promotions, by email, SMS, or social media. You can opt out of direct marketing at any time by using the “unsubscribe” link in our emails, replying “STOP” to SMS messages, or contacting us using the details in Section 12. Opting out of marketing does not affect communications we send you that relate to a service, installation, or competition you have already engaged with or entered.

8. Cookies and website analytics

Our website may use cookies and similar tracking technologies, including tools such as Google Analytics and the Meta Pixel, to understand how visitors use our website and to measure the effectiveness of our advertising. These tools may collect information such as your IP address, browser type, pages visited, and referring website. You can adjust your browser settings to limit or block cookies, though this may affect how parts of our website function.

9. Data quality and security

We take reasonable steps to keep personal information accurate, up to date, and secure, including restricting access to personal information to staff and service providers who need it, using secure systems for storing customer and payment records, and reviewing our data handling practices from time to time. No system is completely secure, and we cannot guarantee the security of information transmitted to us electronically.

10. Access and correction

You can ask us for access to the personal information we hold about you, or ask us to correct it if it is inaccurate, out of date, or incomplete. To do this, contact us using the details in Section 12. We will respond within a reasonable time. In some circumstances permitted by law, we may need to decline a request for access or correction, in which case we will explain why.

11. Data breaches

If we become aware of a data breach involving personal information that is likely to result in serious harm, we will assess the breach and notify affected individuals and the Office of the Australian Information Commissioner (OAIC), in line with our obligations under the Notifiable Data Breaches scheme.
